RTE, when deciding upon the procurement strategy for the contract, estimated that its value was in the region of 180 000 EUR. Article 6 of the European Communities (Award of Public Authorities' Contracts) Regulations 2006 (‘Procurement Regulations’) (which implement Article 9 of the Public Sector Procurement Directive 2004/18/EC of the European Parliament and of the Council (‘Procurement Directive’)) make clear that the Procurement Regulations only apply if the contracting authority's estimated valuation of the contract is above the EU threshold ‘when the contracting authority begins the contract awarding procedure’. As the estimated value at that time was below threshold, RTE determined that the Procurement Regulations were not applicable to the procurement of the contract. RTE undertook an open procedure in respect of the contract, but on the basis that the Procurement Regulations were not applicable. RTE issued a contract notice and tender documents in respect of the contract on the Irish procurement website www.etenders.gov.ie - RFT 102165 - 16005 - Media Transcoding Solution. Any firm interested was eligible to submit a tender in respect of the contract. Any firm interested in the Irish market is entitled to register on the e-tenders' website. It ultimately transpired that the value of the contract to be awarded is above the EU threshold. However, RTE is of the view that the procurement was not subject to the Procurement Regulations because, at the time it began the open procedure, the contract value was estimated to be lower than the EU threshold. RTE's estimate was reasonable at the start of the open procedure, as is corroborated by other tender submissions.
